EXTRACT FROM THE INTERNAL REGULATIONS OF THE GENERAL TERMS AND CONDITIONS OF SALE: LA PLAINE TONIQUE CAMPING AND RENTALS
PREAMBLE
The Camping **** and Leasure Park La Plaine Tonique, hereinafter referred to as “La Plaine Tonique”, is part of the community facilities managed by the Communauté d’Agglomération du Bassin de Bourg-en-Bresse, domiciled at 3 avenue Arsène d’Arsonval – CS 88000 – 01008 BOURG-EN-BRESSE CEDEX.
A public authority manages this community campsite.
Language of the contract
These general terms and conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.
Civil Liability
It is up to the customer to have subscribed to a civil liability insurance.
Period of withdrawal
According to Article L. 221-28 12° of the French Consumer Code, the right of withdrawal is not applicable to accommodation, transport, restaurant and leisure services provided on a specific date or at a specific time.
Mediation and appeals
These general conditions are subject to the application of French law. The same applies to the rules of substance as to the rules of form.
In the event of a change to our general terms and conditions of sale after the booking contract has been sent, the conditions that are most favourable to the customer shall apply.
In case of a complaint, the client will address in priority to La Plaine Tonique to obtain an amicable solution.
Moreover, in accordance with articles L.152-1 to L.152-5 of French Consumer Code, any consumer has the right to have recourse free of charge to a consumer mediator for the amicable resolution of the dispute which opposes them to a professional. To this end, La Plaine Tonique guarantees the consumer effective recourse to a consumer mediation system.
In the event of a legal dispute with La Plaine Tonique, you can contact us as follows:
– Sending a letter by registered letter with acknowledgement of receipt to the management of the Campsite and Leisure Base La Plaine Tonique 599, route d’Etrez 01340 MALAFRETAZ – France.
– Sending an email with a request for acknowledgement of receipt and reading of this email to direction@laplainetonique.com.
If you are not satisfied with the reply, you have the possibility to refer the matter to SAS Médiation Solution, after a period of one month following the sending of this mail/e-mail. Under no circumstances will La Plaine Tonique pay any damages or interest as a result of claims.
In case of legal dispute, only the administrative court of Lyon is competent.
Reimbursements
The various conditions of reimbursement are set out in the full version of the internal regulations of the general terms and conditions of sale. Requests for reimbursement must be made by letter or e-mail, together with an official bank account number and official documents. Incomplete files will not be processed.
In the event of overpayment by you, less than 50 €, no refund will be made. A commercial gesture may possibly be proposed. […]
Personal data
Personal data of customers are collected and processed by La Plaine Tonique. Some data are essential to manage clients’ booking and will also be used to send them information and/or promotional offers. In accordance with article 40 of French law n° 78-17 of January 6, 1978 called “Informatique et Libertés” law, customers have the right to access, modify, correct and delete personal data concerning them. To exercise this right, please send us a letter clearly stating your surname, first name, address and, if applicable, your customer number to: Camping et Base de Loisirs La Plaine Tonique 599, route d’Etrez 01340 MALAFRETAZ – France.
COMMON CONDITIONS – CAMPING TOURISM
1. Booking procedure
Bookings are processed from the second week of January in chronological order of receipt by our services. Please note that it is strongly recommended that you book your stay, especially for the months of July and August. You can book directly online on our website from mid-January or ask for an option by mail or e-mail. In return, you will receive a reservation contract in two copies.
You then have a period of 10 days (deadline, postmark as proof) to confirm this by returning one copy of the signed contract, accompanied by a deposit of 25% of the total price of your stay. For all bookings, booking fees (15 €) are charged, to be paid at the same time as the 25% deposit. Your booking becomes firm only on receipt by our services of these documents. We will then send you a booking confirmation together with the deposit invoice.
All the accommodations are nominative and cannot be transferred or sublet in any way (outside of a contract with a tour operator). Only registered persons are authorised to occupy the accommodation or pitch allocated to them. The number of persons may not exceed the maximum capacity of the chosen accommodation.
For any booking in times of pandemic or in case of force majeure, please refer to title 4 of the full version of the general terms and conditions of sale.
2. Arrival / departure changes
Early departure or late arrival will not give rise to any refund. If we do not hear from you before 7.30 pm on the evening of your expected arrival date, we reserve the right to cancel your booking and keep the total amount of money received.
On-site payment against invoice is required or a subsequent invoice will be issued to any person, animal or undeclared item noted by our staff.
3. List of participants
The surnames, first names and dates of birth or, failing that, the ages of the participants must be entered in the table provided for this purpose on the booking contract and returned to us with the contract or at the latest on the day of arrival.
4. Acceptance of minors
Minors must be accompanied by an adult of legal age for the period of the stay. They must have written parental authorisation if not accompanied by their parents.
5. Method of payment
Payments can be made :
* by credit card (CB, Visa, Mastercard) online or on-site

* in cash (on site or by money order) with a maximum of 300€ per stay at different dates (art. 19 LFR 2013)
Bank charges are to be borne by the customer.
6. Tourist taxe
The tourist tax will be adjusted according to the number of adults and nights. Its price is deliberated by the community council.
7. Cases of possible partial or total refund
Requests for refund must include a letter or email request and a bank account number (official document from the bank). The cases of possible refunds are detailed below:
7.1. By your doing – Cancellation
Any cancellation on your part must be notified to us by registered letter with acknowledgement of receipt or by e-mail with acknowledgement of receipt on presentation of official documents (medical certificates, attestations…) and a complete file. Any incomplete file will not be processed and will not be refunded.
If it intervenes:
-more than 30 days before the start of your stay, we will reimburse the totality of the sums received, minus booking fees (15 €) and cancellation fees (20 €), only in the case of long-term illness, pregnancy complication leading to immobilisation, accident, death, change of cohabitation (divorce), professional change (dismissal, consequent loss of salary. …), cancellation of a private event (marriage, cousinhood, birthday…), cancellation of a public event (sports meeting/competitions, festival…), cancellation of a client leading to the cancellation of other stays because these clients are united by friendly/family ties upon presentation of an official document;
-less than 30 days we keep the totality of the sums collected.
However, less than 30 days or during the stay only for death, long term illness, pregnancy complication leading to immobilisation, dismissal and accidents leading to invalidity: the nights not spent will be reimbursed. In all cases the campsite will retain booking fees (15 €), and will apply cancellation fees (20 €).
-In the event of cancellation by a client reserving the same accommodation/pitch in common with other clients, the balance due is to be paid by the others.

SPECIAL TERMS AND CONDITIONS – CAMPING FOR TOURISTS
1. Payment of the balance of the stay

-In the event of incivility and non-respect of the internal regulations, we reserve the right to expel any person present on the Campsite and Leisure Park. The sums collected remain the property of La Plaine Tonique. The nights spent are due.
2. Animals
Pets are limited to 2 per camping pitch. They must be kept on a leash and have their vaccination record up to date (to be presented on arrival).
SPECIAL TERMS AND CONDITIONS – RENTAL ACCOMMODATION
1. Late booking
If you booked less than 30 days before the start of your stay, the total amount of the stay is required at the time of the booking.
2. Payment of the balance of the stay
Your stay in individual accommodation (mobile home, cottage, safari tent or tepee) must be paid no later than 30 days before the start of your stay. We will then send you a paid invoice. Any stay not paid for within this period is considered to be cancelled by you and will not give rise to any refund.
3. Damage warranty
When you receive the keys of your accommodation, a guarantee (150 € per accommodation) is requested in the form of a credit card imprint or exceptionally in cash. You then have 24 hours to inform us of any possible gaps in the inventory using the form given to you on your arrival. This guarantee will be fully returned on the day of departure or within 8 days at the latest after a satisfactory inventory has been carried out by our staff. Otherwise, we will issue an invoice for the costs of restoring the premises or replacing missing or damaged equipment. Once this invoice is settled, we will return the guarantee in its entirety. In the case of a credit card guarantee, we are entitled to deduct the amount invoiced from the initial guarantee, if necessary. The balance will be returned to you within 8 days.
4. Pets
Pets are not allowed in the rental accommodation.
BBooking terms and conditions are subject to Law n° 92-645 of 13/07/1992 and Decree n° 94-490 of 15/09/1994 which govern business related to the organization and sale of holidays.
